These Terms of Service ("Terms") govern your use of the Ausculta Cor platform and services provided by Winter Shand Inc. ("Company," "we," "us," or "our"), a corporation organized and existing under the laws of the Republic of the Philippines, with its principal office in City of Makati, Metro Manila.
Ausculta Cor is a Business Process Outsourcing (BPO) platform that delivers specialized, agent-assisted video and audio communication services, including support grounded in empathy, emotional awareness, and compassionate engagement. By accessing or using the platform, you engage Winter Shand Inc. to provide professional communication and support services designed to address both practical and emotional needs.
Purchase of Service Credits is required in order to access the services. All transactions shall be processed in United States Dollars (USD).
Nature of Credits: Service Credits constitute a prepayment for professional services, labor, and platform access. Such credits do not constitute currency, shall have no monetary value outside the platform, and are strictly non-transferable.
Statement Descriptor: You acknowledge and agree that all charges will appear on your bank or credit card statement under the descriptor "AUSCULTA COR" or "WINTER SHAND INC."
Clients agree to use the platform solely for lawful purposes in accordance with the laws of the Philippines. We reserve the right to suspend or terminate any account engaged in illegal, harassing, or otherwise prohibited activities as defined under applicable Philippine law.
Winter Shand Inc. provides the services on an "as-is" basis, without warranties of any kind. While we endeavor to maintain continuous platform availability and optimal performance of our video communication technology, we shall not be held liable for any indirect, incidental, special, or consequential damages arising from technical disruptions, service interruptions, or internet connectivity issues attributable to the client or third-party service providers.
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any legal actions shall be filed exclusively in the courts of City of Makati, Metro Manila.
